2.5 Municipal contracts, public places contracts and road contracts On 1 October 2013, Standards New Zealand published the new contractual terms of contract NZS3910:2013 for the construction of buildings and civil engineering (the 2013 revision). The 2013 revision partially replaces NZS 3910:2003, along with two other new NZS terms and conditions to be published later this year. The other two NZS terms and conditions relate to: The note attached to the draft states that the review is a limited technical revision of NZS 3910 and that authors are invited to focus their comments on the identified changes. There is a prescribed format for feedback and any feedback that does not relate to the scope of the technical review will be accepted but cannot be considered as part of this review. These comments will be postponed for reference to a later date. Provides a standard form of the general contractual conditions to be included in the construction contract documents. It allows clients, engineers and contractors to quickly enter into contractual agreements that enable a variety of construction and civil engineering projects. Contracts based on this standard are comprehensive but at the same time easy to understand and reflect a fair distribution of risk between the parties. The standard contains provisions of substantive commercial law that comply with the requirements of the Construction Contracts Act 2002. This revision of NZS 3910 is a “limited technical review” that focused solely on feedback from the construction industry, resulting in clearer wording and reducing the need for extended special conditions. It is also relevant for clients, contractors, subcontractors and consultants.
These restrictions were previously included in Form NZS 3910:2003 of the Contractor`s Bond, although they were not always specified in an on-demand bond typically required by a principal. As part of the current revision of NZS 3910, New Zealand Standards plans to develop online contract forms based on NZS 3910 calendars, which will be available per user. Users can prepare drafts electronically during the negotiation phases and then print the final copies once they are completed and the costs are incurred in the final printing phase. The intention is to offer a number of options for this service with a single-use, multiple-use and unlimited-use pricing structure. The rationale for this approach is that New Zealand Standards believes that users who have already purchased NZS 3910 have distributed the document to other non-purchasing parties or that clauses of the standard have been used to develop “internal contracts available for purchase”. A scoping report commissioned by the NZ Construction Industry Council (NZCIC) recommended a review of New Zealand`s contractual conditions for the construction of buildings and civil engineering (NZS 3910:2013) to ensure that they are fit for purpose and generally accepted. CCNZ is a member of the NZCIC and will play a key role in the review process. This course examines NZS 3910 from the perspective of the engineer for the contract and the engineer`s representative, who must perform a complex “dual role” as a consultant and client representative, in addition to independent and impartial decisions under the contract. With the strong support of CCNZ, the NZ Construction Industry Council (NZCIC) took the lead in commissioning Standards New Zealand to conduct a scoping process for the review of NZS 3910. The fact that this is a limited technical revision means that a number of shortcomings that NZS 3910 users have noticed over time may not be addressed in the body of the standard form and need to be corrected through the Special Conditions – Other Conditions mechanism….
